Back in 1996 Robert Bragdon, Mark Perley, Paul Pyres, Ruth Francis, Norval Sappier, Kevin Bear, Tanya
Wilkens and David Paul were acquitted for gambling charges. This resulted in substantial court
costs paid by the band. It seems that Gerald Bear delayed large payments to the solicitors who were
adamantly requesting payments. At the same time they were given a blueprint to establish & manage a
legal casino which never was followed to this day.
The casino was the brainchild of the previous administration and not this one as people were led to
believe. In April of 97 a management agreement was signed with Calumet. The casino was started
before any approval from the government. On June 27 of the same year a promissory note for $1.18 Mil
was signed again by Mr. Bernard and witnessed by (guess who?) Stewart C Paul. On Dec. 17, 1997, a
Loan Agreement was signed between the Maliseet Nation @ Tobique and Calumet International Inc. Of
S. Dakota by Edwin Bernard . The loan agreement allowed the First Nation to borrow up to $14 Mil. with
an interest rate at high New York Prime plus 2%

It included a note referring to the following: if the band is not operating a gaming facility, with the required
governmental approval, the lender has option to make loan payable with notice.
The conditions of lending were as follows;
The province has never declared Tobiques proposal a legal operation.
The contractor was none other than W. Andrew Lemesurier (now a Liberal appointed Judge) of St. John
N.B. who owned KCC Contractor Inc. There were four people involved in the inception of this casino and
three have been councilors with no education from the start. These people also took many extravagant
trips along with their families at that time. And we were also paying a gaming commission very large
amounts of money sometimes weekly. Gerald Bear was one and would receive large sums of money
weekly with no accountability. On Oct 7 they received a letter stating that the province declined their
proposal for a gaming licence and again on the 15th. Gerald Bear still requests large sums of money
with the gaming commission and receiving very large sums. On Dec 17 as stated above the loan
agreement was signed without any consultations with the community. In Feb of 98 two unidentified
council members questions the validity of the BCR's signed. And that they are being signed out of
council. (truck stop BCR's). March 10/98 Edward Perley informs a trustee that the project for the First
Nation is near completion with the Provincial government and they advance another $75K US. In sept
another promissory note was signed by Mr. Bernard for $4.65 Mil.
In June 99 a letter from a US law firm was sent to the band as a notice for non payment of the promissory
note and requests info on accounting record for the enterprise, annual audit report and a report of the
status of the Peace Hills Trust loan. In Jan of 2000 a letter to Kevin Bear with copies related to the
advances made in the last 2 years. Throughout all of this the BCR's were very questionable to say the
least. And the interest on these loans would choke a dead horse.
In the first two years of operation of the Maliseet Farms reported a net loss of over $500,000 in 97 and
over $700,000 in 98 for a total of $1,247,486. And they do not take into consideration other major losses.
A considerable deficit for a farming industry venture. Large salaries and benefits contributed
considerably to the deficit. Salaries were larger than the net gross. Tobique took the brunt of these high
salaries even back then. A large portion of expeditures were incurred before the financing was secure.
over a 3 year period the total investments from 5 lenders was aprox. $1.8 Mil. Since no financing was
received, Tobique could not come up with more funding so the operation shut its doors in 98. It is normal
business sense to secure financing before undertaking a venture.
Lack of proper financial controls lead to it's failure. Also, there were no financial controls by the
management of Maliseet Farms Ltd. Both farmers that leased to Tobique put a lien on the assets to
satisfy the liabilities owing them. Also as a result were the liquidation sales which both farmers enjoyed.
Again, even though a proper business plan was on the table there was no proof of sticking to the plan.
Again, Stewart C Paul was the lawyer, when asked for supporting documentation he refused stating that
he did not get paid for his services.
In the fall of 1989 Stewart C. Paul becomes chief and in the same year TEDCO was incorporated.
